Note that federal law outlines two kinds of workplace sexual harassment. Other behaviors that do not contend with the legal definitions can still breach your company’s policy.

Consider what you actually want to accomplish. Do you want to expose your harasser? Or do you want the harassment to end by filing a charge? Sometimes, employees can ask to move to a new position. When you think about your desired result, you’ll have a better idea of how to proceed.
How Seriously Does Your Company Take Sexual Harassment?
Harassment mainly occurs in companies where bad behavior is encouraged. In a permissive work culture, employees are also less likely to speak out. In most cases, they are less satisfied with the result. Yet, if your company has a clear policy against harassment, it’s more likely that the higher-ups will deal with it effectively.
What Does Your Company Policy Say?
Before you speak out, you need to know your company policy. Most companies should have set procedures for reporting harassment. Try to memorize the guidelines and get familiar with the procedure.
Do You Have an N.D.A.?
Think back to when you signed your contract. If you signed an N.D.A., you could face legal consequences if you speak out in public against your employer. Most harassers know this, and they could use your N.D.A. against you.
What Are Your Sources of Support?
You should consider all of your channels of support since harassment can take a major financial and emotional toll. Consider whether or not your friends or family members can offer support.
Try to understand that only you can get the ball rolling. You can attempt the following options.
Stay the Course
A lot of women are afraid of reporting any type of harassment due to retaliation or pushback. If you want to wait things out, don’t stop documenting the harassment. If you choose to speak out when you feel comfortable, you’ll have more evidence.
Tell the Harasser to Stop
Some studies find that a direct confrontation could terminate the harassment. You could talk to the harasser and tell them about the behaviors that are bothering you. That way, you also have the legal advantage.
If you believe that your harasser has mistreated others at work, you could build solidarity. Create a support group with the other victims. If you choose to pursue the harassment legally, you will have a stronger case.
Talk to a Lawyer
If you have no plans of filing a lawsuit, a talk with a lawyer can still be helpful. The lawyer can instruct you on key employment or harassment laws. This could narrow down your range of options and give you some ideas on how to proceed.

Before you make a claim, you should consider the following.
Follow Your Company’s Procedures (If They Exist)
As mentioned, you need to know your company’s rules. This will show that you are prepared and serious. One tip would be to write an account of the case in as much detail as possible. If you send the report to your supervisors or human resources, they will have your first-hand account along with an accurate record of the date and time of when you made the claim.
Consider Going to a Senior Leader or Human Resources
If you are being harassed by a company leader, you could file a complaint with another senior leader or with H.R. It’s not always easy to make a claim, especially if the person harassing you is a higher-up who can simply erase your report.
Another way would be to reach out to E.E.O.C (Equal Employment Opportunity Commission). This federal agency could address your harassment complaint quickly.
The #MeToo movement was started mainly by victims who spoke out against their harassers online. That includes Susan Fowler along with multiple victims of Harvey Weinstein. Yet, as we’ve said, you need to be aware of your company policy. If you ignore your N.D.A. or other policy rules, your company could sue you for going public. For eight months, reporters at the British Daily Telegraph worked on an explosive #MeToo story about a well-known businessman accused of sexual harassment and racial abuse.
This week, one of the top judges in England and Wales ruled that the paper could not reveal the name of the alleged perpetrator or the companies for which he worked.
Then, on Thursday, a politician revealed the name of the alleged attacker on the floor of Parliament. Lord Peter Hain told the House of Lords that retail billionaire Philip Green was the subject of the Telegraph piece. Hain said he decided to reveal the name publicly because of the “serious and repeated” nature of the claims.
“Having been contacted by somebody intimately involved in the case of a powerful businessman using nondisclosure agreements and substantial payments to conceal the truth about serious and repeated sexual harassment, racist abuse and bullying which is compulsively continuing, I feel it’s my duty under parliamentary privilege to name Philip Green as the individual in question, given that the media have been subject to an injunction preventing publication of the full details of a story which is clearly in the public interest,” Hain said.
Green, a retail tycoon, is the owner of several retail stores including Top Shop. He is worth about $5 billion. Requests for comment from Arcadia Group, of which Green is chairman, were not immediately returned.
The Telegraph’s #MeToo story has been the subject of much conversation this week, raising questions about free speech and the use of nondisclosure agreements.
In granting the temporary injunction, the judge, Sir Terence Etherton, ruled that the businessman was protected because at least five of his alleged victims had signed nondisclosure agreements and received “substantial” payouts. Publishing the allegations would amount to a breach of those deals, the judge wrote. The alleged perpetrator must be given an opportunity, the judge wrote, to show why his anonymity should be protected.
“There is a real prospect that publication by the Telegraph will cause immediate, substantial and possibly irreversible harm to all of the Claimants,” Etherton wrote in an opinion.
The Telegraph argued that the ruling was unfair because the newspaper did not have an agreement with the businessman in question. Its attorneys argued that there was a “clear public interest” in publishing the findings, “not least to alert those who might be applying to work for him.” According to the Telegraph, the businessman spent upward of $600,000 in fees for seven lawyers to fight publication of the piece.
On Wednesday, the Telegraph filled its front page with a story about the story. “The British #MeToo scandal which cannot be revealed,” the headline read.
“The accusations against the businessman, who cannot be identified, would be sure to reignite the #MeToo movement against the mistreatment of women, minorities and others by powerful employers,” the paper wrote in the article.
Critics say nondisclosure agreements are often used to silence critics and hide patterns of bad behavior.
British Prime Minister Theresa May has said that she would like to pass a law restricting the use of these kinds of agreements. On Tuesday, Maria Miller, chair of the Women and Equalities Committee in the House of Commons, called the use of gag orders “shocking.” NDAs should not be used “where there are accusations of sexual misconduct and wider bullying,” Miller said.

Researchers examined national news stories targeting people accused of sexual harassment and other workplace misconduct, including celebrities such as Louis C.K., and Bill Cosby, as well as corporate executives such as former Intel CEO Brian Krzanich, who was forced out of the company last week after his affair with an employee was revealed.
The report found that there has been an uptick in fired employees and managers following the bombshell sexual harassment accusations levied against disgraced Hollywood producer Harvey Weinstein last October. Out of the 414 people who were implicated in misconduct,190 were fired or left their employer; another 122 were suspended, put on leave or are being investigated; and 69 of them have faced no ramifications since December 2016, according to the new report. The number of people being accused of harassment in the workplace has slowed down, but the percentage of those being terminated has gone up.
“It started to become a tsunami, certainly after Weinstein, and it sparked other stories in the same industry and then across all industries,” Davia Temin, whose Temin & Co. firm conducted the research, told Time. “I think it’s settled into a new plateau, but it is certainly higher than we’ve ever had before.”
Companies across all industries are taking a zero tolerance policy toward sexual harassment. In December, Microsoft — which has faced accusations of tolerating harassment and discrimination against female employees — eliminated forced arbitration agreements with workers who make sexual harassment claims.
A previous NBC and The Wall Street Journal poll found that nearly half of women (48%) employed in the US say they have personally experienced a sexual advance, verbal or physical harassment at work. What’s more, nearly half of men (49%), said the recent #MeToo movement has made them think about their own behavior towards women.
But some workers still believe there is much work to be done to eliminate sexual harassment in the workplace. About one-third (32%) of American workers said their employers have not taken new action to prevent workplace sexual harassment, according to a separate survey by the American Psychological Association. Nearly one in five (18%) said their employer had only reminded workers of the existing resources such as HR or training available.
